JLSG INNS LIMITED – General Terms & Conditions

1. Definitions

1.1 Charges: the charges payable by the Customer for the supply of the Services in accordance with Charges and payment below.

1.2 Commencement Date: the date the reservation is made.

1.3 Conditions: these terms and conditions as amended from time to time.

1.4 Contract: the contract between you and JLSG Inns Limited for the supply of services in accordance with these conditions. This is formed when a reservation is confirmed by JLSG Inns Limited.

1.5 Customer: the person or organisation who purchases Services from JLSG Inns Limited.

1.6 Data Protection Legislation: the UK Data Protection Legislation and (for so long as and to the extent that the law of the European Union has legal effect in the UK) the GDPR (General Data Protection Regulation ((EU) 2016/679)) and any other directly applicable European Union regulation relating to privacy.

1.7 Premises: The Sally, Irthington Carlisle CA6 4NJ

1.8 Reservation: the agreement made regarding the room and rate.

Thank you for choosing to stay at the Premises. The Premises is owned and managed by JLSG Inns Limited (“we”, “us”, “our”). This agreement sets out the terms and conditions relating to you (“guest”, “Customer”, “you”) and your stay.

Together both you and JLSG Inns Limited are the parties.

2 Interpretation

2.1 These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.

2.2 This contract formed when we confirm your reservation. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

2.3 Nothing in these terms and conditions is intended to affect your other legal rights.

2.4 If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.

2.5 We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.

3 Business Account

3.1 Before you can be granted a business account with us, we will carry out credit checks. By applying for a business account with us, you confirm that you agree to us (or a reputable third party credit reference agency nominated by us) to undertake a credit reference search. Any credit search will place a “footprint” on you or your organisation’s credit file (including those of directors, owners, partners or equivalent) whether or not the application for a business account is successful.

4 Room Reservations

4.1 You must be at least 16 years old to make a reservation.

4.2 You will need to provide your credit or debit card details to secure your reservation.

4.3 Please ensure that the details of your reservation are complete and accurate before you confirm your reservation. We will not be liable for any delay or non-performance if you provide us with incorrect information.

4.4 If you think that there is a mistake in your reservation or if you require any changes to a confirmed reservation, please contact us to discuss.

4.5 When you make a reservation request, we’ll give you a total price for the rooms and number of nights you’ve requested. The price you pay is the price quoted to you at the time you make your reservation.

4.6 Payment may be made by cash, credit/debit card (Visa, MasterCard, Maestro and Electron). The expiry date of your debit/credit card must be later than the end of your stay. We do not accept personal cheques. If you have successfully applied for a business account you will be entitled to payment credit terms up to 14 days post-reservation date, this is subject to the credit limit and at the discretion of us.

4.7 .If you fail to make a payment due to us under the Contract by the due date, then, without limiting the our remedies, then you, the Customer, shall pay interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgment. Interest under this clause will accrue each day at 8% a year above the Bank of England’s base rate from time to time. This is claimed under the Late Payment of Commercial Debts (Interest) Act 1998. We also reserve the right to issue a claim for compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

4.8 All amounts due under the Contract shall be paid in full without any set-off, counterclaim, deduction or withholding.

4.9 Reservations are specific to the person making it and so cannot be resold or transferred to anyone else.

4.10 You may be asked to provide a copy of your ID. If you are not a UK citizen, you will be required to give details of your passport/ID card.

4.11 Provided you have been accepted for a business account, we will provide you with a credit limit. This credit limit will be notified to you on successful application for a business account.

5 Rooms

5.1 The maximum occupancy of a room will be detailed when making a reservation.

5.2 Children under 16 are not permitted to stay unless a parent or guardian is also staying in the hotel.

5.3 If you need an accessible room this should be requested upon making a reservation. Please note however that Due to the age of the Premises all of our bedrooms are located on the first floor with no lift access. We do have a hand rail if your have limited mobility and could manage stairs with, assistance, however we are afraid it would be unsuitable for those with wheelchair or severe mobility issues.

5.4 If your reservation includes food this will be detailed within the reservation.

5.5 We will try to accommodate any special requests however all rooms are subject to availability.

6 Arrival and Departure

6.1 Check in is available from 3.00 pm to 10.00 pm (15:00 to 22:00) on the day of arrival. Check-in times outside of those specified must be confirmed with us prior to arrival.

6.2 We ask that you please vacate your room by 11.00 am (11:00) on the morning of departure. Late checkout may be available. A charge may be incurred if you leave after 11.00 am without late checkout.

7 Cancellations

7.1 Cancellation by you.

7.1.1 If you cancel a room more than 7 days before the first day of your booking you not be liable to pay for the cancellation of your reservation;

7.1.2 If you cancel within the period of 4-7 days before the first day of your booking you will be liable to pay a cancellation fee of £50 for the cancellation of your reservation;

7.1.3 If you cancel within 3 days before the first day of your booking you will be liable to pay for your entire stay to cancel of your reservation;

7.1.4 The above includes shortening your stay both before and after the first night.

7.2 Cancellation by us.

7.2.1 If you fail to pay us when you are required to do, we may cancel your reservation with immediate effect on notice to you (including by email).

7.2.2 If you do any of the following we can cancel your reservation, eject you from the Premises and retain all sums paid/charge the full amount due under the reservation:

7.2.2.1 Smoke anywhere inside the Premises;

7.2.2.2 Bring in pets (except for assistance dogs);

7.2.2.3 Bring in illegal or dangerous substances;

7.2.2.4 Tamper with/remove/damage/destroy any of the fixtures or fitting in the Premises;

7.2.2.5 Disturb other residents or staff;

7.2.2.6 Download or access any unlawful or obscene material on the Premises.

7.2.3 If an event outside our reasonable control is reasonably likely to prevent us from performing your booking we may cancel your booking on notice to you (including by email) and will refund in full any payment made by you in respect of such booking by gift card or by free transfer. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control. This does not affect your statutory rights.

7.3 If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract.

7.4 Nothing in Clause 7.1 shall apply to Non-flex rooms. As Non-flex rooms are made available at a promotional discounted rate, these rooms cannot be cancelled, modified or refunded.

7.5 You may wish to take out adequate room cancellation insurance in case you need to cancel your reservation or in light of an event outside of our control (Force Majeure).

7.6 If you secure a dining reservation using a debit / credit card or a deposit has been taken in respect of large parties or afternoon teas and you do not give 48hrs notice or do not show we have the right to use those card details to charge the card to the amount of £10pp

8 Liability

8.1 We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.

8.2 We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control.

8.3 If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and a reasonably foreseeable consequence of such breach.

8.4 We shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses including:

8.4.1 loss of income, sales or revenue;

8.4.2 loss of business;

8.4.3 business interruption;

8.4.4 loss of profits or contracts;

8.4.5 loss of anticipated savings;

8.4.6 loss of data;

8.4.7 loss of reputation and/or goodwill; or

8.4.8 wasted management or office time.

8.5 Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your reservation unless the Hotel Proprietor’s Act 1956 applies, in which case our liability will be limited to the maximum prescribed under that Act.

9 Miscellaneous

9.1 Smoking

9.1.1 Smoking is NOT permitted within any part of the Premises. Please note that ashtrays are provided at the rear of the building on the patio area offending guests. Any guests found or suspected to have breached this policy may be asked to leave immediately and may be liable for professional cleaning of any rooms and any outstanding balance of nights booked.

9.2 Car Parking

9.2.1 A car park is available for guests’ use subject to availability of spaces. Cars parked here are at owner’s risk.

9.3 Missing and Damage

9.3.1 We reserve the right to charge for missing items.

9.3.2 You are responsible and liable for any breakages or damages which you cause to the accommodation or its contents. Please report these as soon as they occur. We reserve the right to charge for repair or damage.

9.4 Price

9.4.1 We reserve the right to change our prices at any time. This does not affect bookings already made.

9.5 Wi-Fi Access

9.5.1 By using our Wi-Fi Service you automatically agree to the terms and conditions of use in force at the time.

9.6 VAT

9.6.1 All published rates are inclusive of VAT at the current rate.

9.7 Keys

9.7.1 You will be provided with a set of keys when you register on arrival. You have full responsibility of these keys for the duration of your stay. Lost keys will be charged at £50.00 per set.

9.8 Lost Property

9.8.1 We are happy to return items that have been left following departure. However, there will be a minimum charge of £10.00 to cover postage and packaging. We accept no responsibility for any loss caused by the postage carrier.

9.9 Restrictions

9.9.1 You must not provide your business account membership benefits offered by us to any third parties, for value or otherwise.

9.9.2 You must not use vouchers in connection with any business account booking.

10 Jurisdiction

10.1 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.

11 Governing Law

11.1 The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
